Fair Usage Policy

  1. Introduction

    This Fair Usage Policy (“Policy”) sets out how our Services may be used and any restrictions on your use of the Services.

    You should check this Policy at our official website as we may change from time to time to address new issues that may arise in connection with your use of the Services or the way we provide the Services. You acknowledge that the latest version of the Policy will apply to your use of the Services, even if you have not read the updated version.

    Undefined capitalized words in this Policy shall have the same meaning as in the Terms and Conditions which can be found at Term and Conditions

  2. General Use

    As a general principle, you must not use the services in any way that is unlawful or illegal or in any way that affects the enjoyment of other users of the services.

    You may not use the Services, either directly or indirectly:

    • to transmit, publish, link to, make available or receive any material which is defamatory, offensive, abusive, obscene, indecent, threatening or menacing;
    • that will be a breach of any person’s rights, including a breach of confidence, copyright, privacy or any other rights;
    • to send electronic materials and messages with the intention or result of affecting the performance or functionality of any computer facilities;
    • to circumvent the user authentication or security process of a host or network;
    • to create, transmit, store or publish any virus, Trojan, corrupting programme or corrupted data;
    • to transmit or cause to be transmitted any advertising, promotional or other materials that are unsolicited;
    • to intentionally disrupt or adversely affect other person’s use of the internet or any features which form part of the internet;
    • in association with a criminal offence; and/or
    • as an internet service provider and/or, if you are a Non-Enterprise Customer, for any business enterprise or commercial purpose.
  3. Personal Usage (for Non- Enterprise Customers only)

    You may not resell or otherwise charge others for the use of the Services. The Services are for recreational, residential, personal use only and may not be made available to anyone outside of the Service Installation Address or used for running programs, equipment, or servers from your residence that provide network content or any other services to anyone outside of the Service Installation Address. You may not connect the Equipment to any computer outside of the Service Installation Address.

  4. Fair Usage

    Our Services are provided with an allowance in the form of a quota for internet access within a specified validity period. Once you exceed your quota, you will no longer have any further access to the services until the start of the following bill cycle unless additional data passes are purchased.

    You shall not undertake any activity that has an adverse effect on the Services or other subscribers to the Services. This includes, amongst others, running port-scanning software, running programs or servers that provide network content or connectivity to any third party not at the Service Installation Address, online gaming, and/or peer-to-peer software or applications. We may suspend or manage the speed of your internet access if we believe your internet usage is excessive.

  5. Security

    You must take reasonable steps to ensure that others do not gain unauthorized access to your account.

    You are responsible for preventing a third party from obtaining access to the network.

    You must keep your User ID and/or password confidential at all times. You shall not use the same for any purpose connected with the improper use of the network including accessing or attempting to access other parts of the services for which you do not have access rights.

    You must not use the services to carry out port scanning or probing (which is an attempt to identify an open gateway into another user’s machine). Where it has been identified that an account has been used for this activity, we may suspend your services without notice.

    You are responsible for the set up and security of your computer and/or any device and any servers that you may run on your computer or any device.

    We will not offer support for the detection or removal of viruses, worms or Trojans. We strongly recommend that you protect your computer and/or device with anti-virus software.

  6. Enforcement on Breach of Policy

    If we have good reasons to suspect that you are in breach of this Policy or any other terms on which we provide the services to you, we reserve the right to suspend or terminate your access to the services. We will give you notice of suspension or termination as soon as it is practical to do so.
